MAYPORT, Fla.-- Police are calling it a burglary in broad daylight, but they say the burglar didn't make it out with anything, not even his life.

The Jacksonville Sheriff's Office tells Action News that a Cypress Cove homeowner's son shot and killed the intruder. The early morning racket woke up neighbor Michael Goulet, who lives just two doors down.

"I think it must have been the window breaking that woke me up."

Goulet says neighbors saw suspicious activity in their yards shortly before shots were fired.

"There were two guys in hoodies back there," said Goulet.

Neighbors like Cathy Fraunhoffer say the incident has encouraged her to invest in a firearm.

"I don't keep a gun in my home. I'm considering getting one if this keeps up," she said.

She says her once-peaceful neighborhood is growing dangerous.

"We've had some cars broken into at night because there's a lot of people walking the streets at 2 or 3 a.m.," she said.

As police continue to investigate how and why this burglar broke into the home, they're also questioning the man who lives there who killed him.

"He's just in our custody now for investigative purposes, and we're at the very beginning stages of this," said Sgt. Michael Paul with JSO homicide.

So far police say no charges have been brought against the shooter.

Another dirt bag stopped. I am a retired cop and I was sitting at home at SW Jax near OP. Someone knocked and I heard the door being kicked in. I didn't have my gun, and by force of habit I yelled police freeze and they ran. If i had my gun it would have been his last break in..and its not even burglary, its criminal mischief.Yet, if I break into your car, its a felony, auto burglary. In NY its felony burglary. WE need to change the statutes so when they kick in the door of a dwelling, occupied or not, its a felony burglary. Am I right or wrong? Hows the home owner doing?

I hope the robber wasn't black. Otherwise the home owner is racist.

GREAT THUGS break in on good hard working people to hurt or rob them, then you deserve to be shot. If you are lucky, it is GOD'S WILL you survive.

That's Atlantic Beach, not Jacksonville ... But either way, that's my neighborhood, and I'm glad we've got a dog to alert us to this kind of thing!
