JACKSONVILLE, Fla. -- A birthday celebration allegedly ends in violence sending the Jacksonville Sheriff's brother to jail.
Things are quiet now, but neighbors living near one particular Westside home said they're used to seeing police there. Turns out, the home belongs to Hubert Rutherford, the brother of Jacksonville Sheriff John Rutherford.
Action News spoke with Hubert Rutherford's ex-wife who said she knows some of what happened.
"He came home from the bar after 2 o'clock in the morning and Victoria and him had gotten into it," said Nancy Carrick.
Carrick told us their daughter Victoria was nearly strangled by her father. She also said Hubert Rutherford's girlfriend, Kari Reynolds, tried to intervene and was also arrested on charges of child abuse and battery. She's out free, but Hubert Rutherford remains behind bars.
"He does have history of domestic violence on females and he definitely needs help," said Carrick.
A police report obtained by Action News shows police found a hand-shaped red mark on the left side of the victim's face and red scratches on her neck. The victim told police Hubert Rutherford came home drunk and began to yell about a stray dog she had brought in with a friend. The victim told police she hit Hubert Rutherford.
Action News did some digging and found that Hubert Rutherford does have a history of violence. Police arrested him in 2009 for fighting. We also found in his records, at least two other arrests for driving under the influence. Hubert Rutherford is being held on $80,000 bond.
Action News asked Sheriff John Rutherford for comment on his brother's arrest. The Sheriff has not responded.
