BRUNSWICK, Ga. -- Action News has learned the teenager accused of shooting 13 month old Antonio Santiago will not be tried in Glynn County, where the crime took place.

On March 21, we heard Sherry West sob just hours after her baby had been shot in his stroller. She said she had taken him for a walk in their Brunswick neighborhood, when she was approached by two teenagers, who she said tried to rob her.

Three months later, those two teenagers, DeMarquise Elkins and Dominique Lang, are behind bars and awaiting trial. But exactly how they should be tried has been a point of contention between the suspects' attorneys.

In court documents Action News obtained Thursday, Elkins' attorney claims Lang's attorney is secretly working with prosecutors on a plea deal that would make sure Lang never stands trial at all.

Lang's attorney denies that claim. "I don't have a deal," said Kimberly Coleman.

But she did say that she wants her client tried separately from Elkins.

"I'm representing the interest of Dominique Lang and that's it," she said.

Looks like Coleman's request has been granted. Other court documents obtained Thursday show the judge has decided to move Elkins' trial to Cobb County, Georgia, fearing an impartial jury will not be found in Brunswick.

Action News ran into Sherry West just three weeks ago at a court hearing for the suspects. She told us she's ready for justice for little Antonio, no matter where the trial is held.

A total of five suspects have been indicted in the case. Elkins, Lang, and three of Elkins' family members are also awaiting trial.

DeMarquise's mother and sister, Karimah and Sabrina, are each accused of trying to hide the murder weapon. And his aunt, Katrina, is accused of lying to investigators by providing DeMarquise with an alibi.

Only DeMarquise has a trial date set. Jury selection is scheduled to begin August 19th at the Cobb County Courthouse.

We have also learned that the attorney for Sabrina Elkins, the sister of DeMarquise, has also requested a separate trial.

Slow and painful, this demon should be put on public display and stoned daily for the rest of his life. There will never be any justification to killing a completely innocent baby on any level. This cancer and his diseased family is weak and evil and all need to rot on this earth so they are prepared to rot in hell until the end of time. Never forget that poor angels face folks, there is nothing more shocking or crappy than Demarquis or the other bi*c* of terrible excuse for an ANIMAL and what he and his are capable of... RIP little one, you are loved and missed here.

End result of the trial will be he gets life in prison. He will be eligible for parole in 35 years. Now ask yourself what would be happening if had he shot a cop or a rich person.

Justice needs to be served. They have the murder weapon, they have the accomplices trying to destroy it. I guess the baby must attacked the black man making him fear for his life by banging his head into the concrete like some kind minature hulk. This is open shut case he killed that baby in cold blood and should pay with blood.

I'd like to know…Why is it that the perpetrators of the crime have more rights, more options of venue than the victims???? This suspect should stand trial in the place that the "alleged" crime happened! I for one am so sick and tired of the criminal receiving all of the options in his/her favor...
