Donald J. Smith denied bond by Duval County Judge; pleads not guilty

JACKSONVILLE, Fla. -- The registered sex offender who is accused of kidnapping and murdering 8-year-old Cherish Perrywinkle was denied bond by a Duval County judge during the suspect's first court appearance Sunday.

The mother was at fault too. She was simply too trusting of a person she just met. She should have been suspicious of a stranger offering to buy her daughter a dress. But she is not to blame for her daughter's death. She does not need to be beat up by the public because I assure you that she is already doing that enough on her own. When I was a child in Poukeepsie, New York, I was within a second or two of being grabbed by a sicko while walking to summer camp at a church. I was scared to cross streets when there were any cars around, but I was only six years old at the time. This man came up behind me at an intersection, and if it were not for a lady stopped there who saw what was happening, I would not be here today. She laid on her horn and started yelling for me to run just as the sicko reached down to grab me, but I ran across the intersection, getting away. I remember this happening as if took place yesterday, despite the fact I'm now fifty-two. The sicko that almost got me was caught due to a description given by my sister to the police chief, who was a family friend. It turned out after the fact that he had killed several kids in the area. The mother of Cherish is only guilty of thinking that such a crime could never happen to her. Well, it almost happened to me, so people need to wake up, our courts need to start doing their jobs, our lawmakers should be passing laws to ensure that these people are never allowed back out into society, and if they must let them free, then Tattoo their foreheads with a warning so people will know to keep their children away. Of course, this is an extreme measure, so it should only be done when the child that was abused has not reached maturity, as there are a lot of kids out there in their young teens who (irresponsibly) think they're adults and are sexually active. I would not want such measures to be taken in a case where the child was a willing participant (i.e. child 15 or 16, having sex with an 18 year old).

This man should never of been released from Jail. His history of abuse with children goes back to when he was just out of High School, which was the first time he was arrested and spent time in jail. I have to wonder before he was in jail this last time, when he was posing as a Child Protective Service Officer, how many children he actual sexually abused before he got caught. I've got to think there were other children, as the likely hood of getting caught the first time is low. I can only hope that he is charged with Capital Murder and gets the death penalty. I would hate to have to be the lawyer assigned to defend this man, because I would probably be disbarred as I did everything I could to insure he got the needle in the arm. Sex offenders are the most likely of any criminal to repeat the crime that caused them to end up in jail to begin with. To let them out and then not supervise them is absolutely incredible. This state's government has their collective heads up their ***s when it comes to crime. If the Jacksonville Police Department had him on their radar as they claimed, then where in the hell were they? They should have been watching this guy like a hawk!! I don't even blame Mr. Smith for what he did, as he's a sick individual who has absolutely no control over what he does. He has no place in our society, and as such, he should never of been allowed out of jail in the first place. Why we allow our jails to be a revolving door for these MONSTERS is beyond me. I blame the courts, the lawyers with their deal making, and most of all, the Judges we have that allow these sick individuals to be walking amongst us. There should never be Parole for Sex Offenders, EVER!!! And when they are released from jail, they should be put away in a mental institution, as they're sick in the head!!! OUR JUDGES NEED TO GET OFF THEIR COLLECTIVE ASSES AND DO THE JOB THEY PAID TO DO, protecting the public while putting away these sicko's so they can never again get near a child!

This man does not need take up any more tax payers money! Stick the needle in and get it over with why have a trial when he is guilty! This baby was taken way to soon and it has effected everyone in our community because we are all asking WHY was a child predator out of jail know he WOULD strike again! An look what he did he took an innocent life away from so many, but more important he took her away from her family!

LUBIN- GPS tracking does no good because they wear an ankle monitor. Who can see it if they are wearing pants. I agree a tattoo is much better of identification for people and children to be made aware of. We should let our representatives aware of this and maybe it will get passed.

This is absolutely horrendous. Even if THIS mom(or any mom) was slack at her parenting when her daughter followed this monster to McDonalds within the Walmart...We SHOULD NEVER HAVE TO TELL OUR CHILDREN DAILY THERE ARE MONSTERS OUT HERE THAT WILL TORTURE AND KILL THEM. The system is still failing our children, why? Because of prison overcrowding? What a sorry excuse, to say our children's life's are LESS important than a habitual drug user who spends decades behind bars. These murderous monsters cannot stop preying on innocent children, the laws are failing them. God is still watching and WAITING for our legal system to WAKE UP.

I honestly don't know how any of those officers could be within 500 feet of this scumbag without beating him to death! I could never be in law enforcement because I would end up going to prison myself for ridding the world of evil like him.
