Dunn Case: Resolution might take longer

JACKSONVILLE, Fla. -- Listening to hours of testimony from his son's accused killer left Ron Davis emotionally exhausted Tuesday. As he exited the courthouse, he told Action News he's ready for a resolution.

"I've been waiting a year and a half for this week."

But Action News has learned a resolution could take even more time than Davis hoped.

Late into the evening Tuesday, Judge Russell Healey and the attorney's for both the state and Michael Dunn continued the long debate over the charges he is facing. For hours, they added and deleted specific words from the instructions that will be read to the jury following closing arguments. Some of those instructions, Dunn's attorney Cory Strolla worried, could confuse the jury.

"Listen, I'm getting tired of debating," said Judge Healey as the debate entered the second hour. "I've asked you people for days to make a decision."

Legal analyst Dale Carson said the jury may be asked to consider something less than the first-degree murder charge that Dunn faces.

"Anything from murder down to aggravated assault could be included in that list."

That means the jury could be given many options, and their deliberation, Carson says, could take many hours, leaving the Davis family waiting even longer.

"My family had been waiting a long time for justice," said Davis. "We just hope to have justice by the end of the week."

Closing arguments are expected to take each side two hours Wednesday, and the judge could take another two hours to read those instructions.
