FHP not releasing blood analysis results in deadly Mandarin crash

JACKSONVILLE, Fla. -- The Florida Highway Patrol has already received the blood analysis results for Michael Fortunato, the man investigators say was driving the car that struck and killed Esther Ohayon and left her teenage daughter badly injured.

But the FHP is remaining tight-lipped about the results despite having had them for months.

Jo-Ann Kagan still remembers the moment she found out someone struck Esther and Orly Ohayon as they both walked to Etz Chaim Synagogue near San Jose Boulevard.

"During the service when the rabbi mentioned it everybody just went silent. The shock just fell over everybody," said Kagan.

The crash happened during Yom Kippur, the holiest day of the year for Jews.

Almost five months later, Kagan says her community is still waiting for answers.

"To recover from something like this, I don't know if you really do," said Kagan.

According to the FHP, charges are still pending for Fortunato.

According to the Florida Department of Law Enforcement, it has already processed evidence analysis in the case and sent it to the FHP. One report was sent in October and the other November. 

FHP public information officer, Sgt. Dylan Bryan, says those results will remain confidential for the time being.

"That information is not being released at this time because it's an ongoing investigation, No. 1, and it could be utilized by our investigators to obtain information later in the case," said Bryan.

According to Bryan the results they currently have tested Fortunato's blood to determine if he was under the influence of alcohol or drugs at the time of the crash. Bryan says they're still waiting on more evidence to be processed.

"One of the items that was requested by our investigator was medical records of the driver and those are being subpoenaed," said Bryan.

Meanwhile the Jewish community is rallying around Orly Ohayon who still requires medical attention.

"All children deserve happiness and for something like this to happen to a child, a Shakespearean tragedy doesn't even touch it," said Bryan.

A benefit concert will be held for Orly Ohayon on Feb. 2 at the Jacksonville Jewish Center beginning at 1 p.m.
