JACKSONVILLE, Fla. -- Efforts to get murder charges dismissed against a 12 year old suspect were denied Friday morning by a judge.

Lawyers for Cristian Fernandez say they plan to refile a motion to dismiss murder charges against the boy. They also plan to fight a new indictment on sex charges. Fernandez has now pleaded not guilty to both counts.

Fernandez, who is the youngest person to be tried for first-degree murder in Jacksonville's history, is now accused of sexual battery on a child under 12. The State Attorney's Office says it orginally held off on those charges, because it was in talks with the Public Defender about a plea deal for the boy. Those talks fell through and the State Attorney's Office announced a new indictment for sexual battery Thursday.

I know that the folk that are working for and on the case for this child are educated degree equipped. But it doesn't take a Master degree, even not a rocket scientist to take a common sense look at the child's growing up situations, that no doubt played a definite role in these circumstances. Seem to me this is a potilicat status effort to lock in points for reputation points. Sending him in a role of prison time, locked in a cell like an animal will not prove not justify ignorance of educated folk. Common sense needs to take a closer look and all that the system think that are on top of, non of the facts prove what is and will be called justice for this child, Abuse, raped, molested, beat both physically and mentally by folk he knew, and was suppose to raise him, only to later cause him to take the rap, pay the cost of adulte stupidity and a system that looks not out so much for justice but points of reputations, and what they call repect. Don't allow your past losses to become your today victims.
