Florida Supreme Court affirms Jacksonville man's sentence

JACKSONVILLE, Fla. -- The Florida Supreme Court is upholding the death penalty decision for a Jacksonville man convicted of killing his ex-girlfriend. Justin McMillian was sentenced to death in October 2010 for the First Degree Murder of 26-year-old Danielle Stubbs.

Stubbs was found dead in her town home by her brother and parents in 2009. McMillian and Stubbs were broken up when he shot her to death after she told him she aborted their child.

Three days later, McMillian was pulled over by authorities in a traffic stop. He then shot at Jacksonville Sheriff's Officers and deputies with the U.S. Marshals Service. No officers were hurt. McMillian was shot multiple times and has since recovered.

Along with the First Degree Murder conviction, McMillian was convicted of Attempted Murder for the gun battle with police. The 28-year-old is now on death row at the Florida State Prison.
