Lawmaker: No smoking with kids in the car

JACKSONVILLE, Fla.-- A local lawmaker just filed a bill to ban Floridians from smoking in their cars if a kid is inside.

There are plenty of rules of the road. State Rep. Charles McBurney said he just filed brand new legislation trying to ban people from smoking while minors are in the car. He told Action News it's not about the government telling people they can't smoke. "This
quite frankly isn't about Big Brother, but little brother in the back seat in the car seat," said McBurney.

Smokers we spoke to didn't want to talk on camera about their habit. While some agree with the proposal, others said it's not fair.

Right now it is just a proposal in the House. A bill in the Senate has not been filed yet. We're told the legislation will be taken up in March.

I would never smoke in a car with small children: but that does not mean we should criminalize stupid conduct" I would never poison your kids, but you don't want the government to tell other people to not poison theirs. Let me guess---you are not a rapist, but you do not want the government to tell other men not to rape.

Oh, Charlie, we barely new 'ye. It must be the air in Tallahassee. I would never smoke in a car with small children: but that does not mean we should criminalize stupid conduct. With 300 chicken ranchers in suburban areas,dysfunctional schools that are breeding grounds for thugsters, a river we can't get dredged, a downtown that has not added a tall building in decades,and our proud claim to being the murder capital of Florida, Jacksonville needs a ban against ignorance and proles and government waste. Let's start with banning stupid nanny state bills.

Another unenforceable nonsense law proposed by a half-with Politico looking to make a name for himself. Like the Cops don't have enough to do as is. The auto today, is regarded by many as an extension of the home. Are we to see Government forcing the will of others upon all of us from the womb to the tomb? I quit smoking years ago but still respect the rights of others. Think carefully about this proposed law. It may very well do more harm than good by opening doors of intrusive enforcement heretofore unthought of.

I hope it goes through - I have asthma and my husband smokes in the car with the window down and I still get choked up. Even if I sit in the back with my grandchild I can still smell it.
