Man accused of killing wife, stepchildren asks judge to release or move him

VOLUSIA COUNTY, Fla. (WFTV) -- A man accused of killing his wife and two stepchildren was in a Volusia County courtroom asking a judge to release him or move him to another jail Monday.

Luis Toledo was arrested in October after Yessinia Suarez and her children disappeared.

Suarez and her children, 9-year-old Thalia Otto and 8-year-old Michael Otto, are presumed to be dead. Their bodies have never been found.

On Monday, Toledo's attorney asked the judge to allow his client to be moved to a facility in Seminole County or to release him.

The attorney said security is too heavy in Volusia County, and it is difficult for him to have private meetings with Toledo.

The judge did not rule on the motion Monday morning, but is reviewing that motion.
Their alleged slayings of Suarez and her children came just hours after Toledo was heard in a 911 call accusing his wife of cheating.

Suarez's family has spoken out several times about the torment they said they have gone through after losing their three loved ones and then waiting to see if Toledo would be charged in their deaths.

Volusia County detectives said Toledo admitted to killing his wife during a heated argument at their Deltona home, but denied killing the children.

A grand jury indicted him and now he's facing three murder charges.
