JACKSONVILLE, Fla. -- A Jacksonville man is facing battery charges for attacking and shooting his uncle at his home.
Police say they found 69-year-old Walter Gibbs shot outside his home early Monday. Inside, his nephew, 23-year-old Kyle Weller was pacing inside the home. Eventually, Gibbs wife, Luanne, was able to convince Weller to come outside the home and surrender. When he came out, police say, Weller was bleeding from a gunshot wound on his leg.
The family told police Weller came to the home and woke up his aunt, Luanne Gibbs. Gibbs told police she asked Weller what was going on and he explained to her he took some acid. He then told her, "I want Mel to kill me." When Gibbs refused, she says, Weller grabbed her and pushed her face-down onto an ottoman. She says her husband then told her to leave the house and she ran outside to get help from a neighbor.
Police say Weller told them he remembers speaking to Gibbs when the two began fighting. Weller told police he was wrestling with Gibbs and wanted him to kill him. But, he says, he does not remember how both he and Gibbs were shot. Weller told police he didn't realize he was shot until his leg felt "weird".
Another family member, a 16-year-old, was inside the home at the time. She was able to get out of the house safely before police arrived.
Police found a gun at the scene.
Gibbs was taken to Columbia Orange Park Center and is in serious condition.
Weller was taken to Orange Park Medical Center to be checked out. Police absentee booked him there and when he is cleared he will be taken to Duval County Jail.
