ST. JOHNS COUNTY, Fla. -- The suspect in an explosion at a gas station will be pleading not guilty.

The state plans to refile criminal charges against David Cowles.

Cowles' attorney filed paperwork today stating that Cowles is pleading not guilty to criminal negligence that led to the BP gas station explosion.

Cowles is accused of leaving his truck unattended while refilling the tanks at the station back in August of 2011.

Cowles, who was severely burnt, was not in court. He faces one charge of misdemeanor culpable negligence/exposing people to injury.

A judge dismissed culpable negligence charges in March because Cowles was off-loading fuel when the explosion happened.

His next hearing is June 10.
