Michael Dunn's attorney: SUV moved after Jordan Davis shooting

JACKSONVILLE, Fla. -- It was an emotional day for Jordan Davis' parents. For the first time since their son's death, they came face to face with his accused killer.

"To see him physically standing before us, I feel so sorry for him, I feel so sorry for him because he has to bear the burden for the rest of his life" said Lucia McBath, Jordan Davis' mother.

A shackled 45-year-old Michael Dunn walked into a Duval County courtroom this morning.

His new attorney Cory Strolla, entered not guilty pleas on all counts and does not discard the possibility of using the controversial Stand Your Ground Law in his defense.

"If the facts fit the law, if they do and I research it, if it's a viable defense, a reasonable defense, I'm going to vigorously pursue that on behalf of Michael Dunn" said Cory Strolla, defense attorney.

Dunn is facing one count of first-degree murder in the shooting death of 17-year-old Jordan Davis and three counts of attempted murder.

According to investigators, loud music sparked an argument between Dunn, Davis and three of Davis' friends.

New details in the case were revealed in court today about the SUV the teens were traveling in. According to Strolla, he expects the police reports to show that the red Durango Davis was in, left the crime scene and came back before police arrived.

"The ballistics will show that if a gun is fired from just a few feet away from where my client's car was and those boys told police they never left the scene, well that's obviously a false report to police," said Strolla.

The Davis family lawyer did not deny that possibility. "What would you do if some one is shooting 10 rounds at you?" said John Phillips, the Davis family attorney.

In a statement released to Action News, Phillips wrote about the teens involved: "They have never been suspected of any wrongdoing and to insinuate to the contrary is unprofessional and irresponsible."  

Meanwhile, Ron Davis said he wished Dunn would've glanced his way during the arraignment.

"I wanted him to look at me to understand that he's taken my life away he's taken Jordan's mother away from him," said Davis.
 

Both sides are due back in court on February 6 for a pre-trial hearing.

I hardly blame Dunn for fleeing. Jacksonville is a cesspool, and all time there should be minimized. The same city that incorporated all of the suburbs to keep blacks out of political office and didn't officially segregate public schools until 1996 is now the center of a case with civil rights implications. FML. The st. johns river flows north... a backwards river for backwards people.

So...according to Dunn the suggestion is that they went away, ditched their shotgun, and then went back to where they had been shot at?!

They never lied about leaving the scene, the gas station cameras showed that they pulled out of the parking spot, but never left the parking lot. they pulled back up after the shooter took off. also the cameras showed no one removing a weapon from the suv, and police found no weapons in the vehicle of the victims. Someone also asked why the driver wasn't arrest for being out past curfew on a probation violation...the shooting happened in broad daylight. The crime scene photos that people have been seeing are from night time because it takes a while to process a crime scene.

Dunn said they started saying 'f-ing kill him' so why did he roll down his window? The supposed "love of his life" is safely in the store so why not just drive away and call 911 instead of pulling out his gun? As for the younger ones leaving the scene I ask who is going to sit there unarmed and let someone continuously shoot at you? You're not. You're gonna drive away. Dunn had ZERO remorse for killing a young man. He went to his hotel room and ordered pizza. Dunn's claim that he didn't want it all to come down there in Jacksonville so he was going to wait till he got home. That's BS because everything already DID go down there. He was hoping he could go home and the police would never find him. He was NOT scared for his life. He did it out if anger. I'm shocked that there are people defending Dunn.

It is not illegal to own a shotgun, and it would not make sense that if the young men had one they would: 1) get rid of it even though it was not fired, or 2) NOT SHOOT BACK!!! Anybody who says they think the young men had a gun and ditched it is basing their presumption on stereotypes, and not on any facts in this case. Personally, I would not stay put while somebody was shooting at me! And Dunn fired 4 or 5 shots as they drove off, claiming he was afraid they might shoot back, even though they never shot at him in the first place! Man seems quite deranged to me, he didn't have the sense to stay nearby or contact police, when he claims some dangerous folks with a gun were driving around pointing it at people? Hard to imagine, his story makes no sense, unless you are a racist.

RBLKMSCORPIO, IF THE YOUNG ADULTS left the seen why didn,t they take their friend straight to the hosptial? why did they return?just saying.the only reason that DUNN, left the scene was he was drunk and he knew he done something wrong.I belive his grilfriend should be charge as well. I have come a cross a lot of young males playing their music up so louad I could not here any thing around me.this day an age they(young kids)white or black have no respect for any one that is older than they are.some times i think they are begging some one to shoot them.I belive they had some type of gun or they wouldn,t have left the scene.but that is up to the Dunn,s attorney to prove.no weapon found then Dunn will get what he gets.

The kids told police they left the scene and came back after they discovered Davis had been shot. Were they suppose to sit there while getting shot at????? Here again we blame the victims because they're black and must of been up to no good! What about young white males and public shootings that happens here in America way to often but our society never looks at them as being "thugs, gangsters......

I wonder why the driver of the SUV ( Tommie Stornes ) has not been put in jail for VOP. He was on felony probation and had a curfew. He violated his probation orders and somebody died. Shouldn't he be charged with murder too?????

a shame. i have a concealed fire arm license. if i'm in a situation where someone threaten's me with a weapon i'll shoot to kill. but i will stay put and show my license and not run. i have a right to have one and will protect myself because someone want's money or to lazy to get a job. the shooter should of stayed put until police arrived. did they have a shotgun? i don't know. the trouble now no one has any respect for anyone ewlse and in a huury,speeding,cutting off people and running red light's. if people didn't run red light's you wouldn't need camera's. common sense tell's you that.
