New documents describe murder suspect's apparent state of mind

JACKSONVILLE, Fla. -- New documents about the death of Cherish Perrywinkle were released Friday.

Police say Donald Smith abducted and killed Cherish in June.

The new documents from the State Attorney's Office say Smith's apparent state of mind in the days and hours before Cherish's death. The documents say Smith drove past another family as he allegedly left a Westside Walmart. The family told police Smith yelled to them, "We're going to get cheeseburgers, follow us." 

Action News spoke to that family Friday. They didn't want to go on camera, but told Action News it was an odd moment.

Before that, Smith's former jail mate turned roommate says he helped him take out the back seats of his mother's white van. Smith was driving that night. Charles Shejen didn't want to conduct an interview, but told Action News, "You think you know somebody until you don't."

After a month in jail, Smith told his mother he couldn't go to prison for fear of being raped and murdered. The documents say in a recorded jailhouse visit,  Smith told his mother he wants to be on death row, saying it would be "simple, happy and peaceful."

The documents say he even told a police officer to tell his mom not to call a lawyer, saying "They're going to kill me anyway. There's no sense spending the money. "

Smith was in court this week. His attorneys are asking the state to spare his life. That motion will be heard in January. His trial is set for May.

Nothing in this article does anything to excuse this P.O.S.'s actions. He is a cyst on the behind of our society and needs to be removed by the swiftest, and most permanent, means available.

"His attorneys are asking the state to spare his life" Are you kidding me?!?!?! Put this animal down, if he wants death give it to him so he doesn't waste anymore of the air we breathe! And doesn't get a chance at an accidental parole and he kills more children! Put him in GenPop let the other tax burdens have at him! I hear there's nothing hated more in prison than child molesters, murderers. What lawyer would defend this piece of *&@$ whoever it is I want to black list him if he's successful at getting him life. Agggghhhhh!! This is the problem with the justice system these days punish to the max those that commit minor crimes, let those that commit the horrendous crimes like this jerk and try to get him an easy sentence. I just don't understand :(

There is absolutely NO REASON to 'spare' this parasites life. He deserves death in the cruelest, painful manner for what he did to an innocent child. STOP wasting tax payers money on human filth. MOST pedophytes will do it again...kill them all. Our children deserve nothing less then REAL and swift JUSTICE.

State Attorneys Office - Do not give him a plea deal like you did with Jarred. The family needs justice done and so does our community need to heal. No child should have to endure that kind of torture, pain, and death. Justice for Cherish.
