JACKSONVILLE, Fla. -- Closing loopholes is what lawmakers say they will do in 2014.

A bill proposed on New Year's Eve marks the fifth designed to strengthen Florida's sexual predator laws. State Sen. Audrey Gibson is behind the new measure that would make it illegal to loan your car to a sex offender or predator.

"I thought if we could do that for traffic offenders, surely we should be able to apply the same kinds of actions to registered sexual offenders and sexual predators who prey on our children," said Gibson.

Gibson's proposal comes more than six months after the kidnapping and brutal murder of 8-year-old Cherish Periwinkle. We've shown you the documents detailing how Cherish's alleged attacker and registered sex offender, Donald Smith, borrowed his mother's van the night Cherish disappeared.

If the new measure had been in effect, Smith's mother would have faced losing her driver's license for a year for letting her offender son use her vehicle.

Action News went to Patricia Moore's home to get her thoughts on this bill. We knocked but no one answered.

"Smith is an evil guy. Nothing about restricting where he got his car from is going to change the vileness of his character," said local attorney Randy Reep.

Reep says this bill will likely be road-blocked by judicial review.

"It puts criminal responsibility on the person who lent them the car. Think about that," he said.

Angels, Nativejax and Savanna - this was a rare and terrible crime. Whoever perpetrated it, will be punished to the full extent of the law. There are over 750,000 people nationwide required to register as "sex offenders", many for life and some children. A law passed to express our outrage at this particular crime is not an effective deterrent - think how many horrible laws are out there already. This politician is reaching for low hanging fruit. The vast majority of people on the registry have not done anything like what happened here. Continuing to punish people after their sentences have been served, creating an environment where they can not find work, can not find housing, can not reintegrate into society - makes no one safer. It's also against the basis of every world religion - forgiveness. I am not condoning this crime. I AM saying do not punish an entire class of people because of it. The label "sex offender" is broad and it is long - often lifetime. The people who commit crimes such as this one - fortunately - are few and far between. Don't confuse the two.

Angels, Nativejax and Savanna, and anyone else who wants to disfigure, mark, or otherwise further stigmatize former offenders -- you are barking up the wrong tree. While you are busy looking for green license plates, forehead tattoos, etc., the VAST majority of child sexual abuse is being perpetrated within the child's own home and close social circle. Meaning that you are banishing, shaming and torturing the wrong people. Wouldn't it be great if we all had a third eye to see who intends to do harm? Reoffense rates are a good indicator - former sex offenders reoffend at 5% or below. Drunk drivers reoffend at over 80%. If anyone should be painted pink, tattooed or never let out of prison, by your reasoning, it should be a drunk driver. They can do terrible damage to people, kill and maim many and reoffend at a high rate. Just sayin'.

Leave it to the people of FloriDUH to come up with a barrage of stupid laws as a response to a bad article inspired by a rare event. Using Floridiot logic, this event would have happened had registered persons not be allowed to shop at Walmart, so I assume someday they will be barred from that too. How stupid is this really? So, now we have to check a registry to loan a car, seriously? How about just holding the registrant responsible, IF they commit a crime...ya know....if the person is that dangerous, they shouldn't be out of jail to begin with, just sayin'

That's a good idea angels074458, but a large number of these losers don't own a car. They are the lowest form of bums on earth and usually 'Prey' on the women first just to get near her child, as in this case.(He claimed he wanted to help the mom to buy her daughter a dress at Walmart) A lot of guys date the mom with the car. home,money, etc. because he's a controlling BUM, that won't/cant get a job. I think they should not be FREE at all after their FIRST OFFENSE. Why does the Judicial system ALLOW one more child to be ruined or murdered just because they don't want to lock them up? There are drunks and drug users in prison that should be forced into hospitals and rehab. there would be plenty of jail cells..ONLY THEN, not one more child will suffer or one more mother, no matter how bad she is, will have to bury their child.
