New trial ordered in killing of Jacksonville woman

JACKSONVILLE, Fla.-- A local man convicted of killing a woman will get a new trial.

The Florida Supreme Court threw out the murder conviction. Delores Futrell was a local grandmother. In 2008, she was stabbed to death in her own home. Before a suspect was arrested, Futrell's daughter Jacki Blades pleaded for justice.

Two years after Futrell's death, Randall Deviney was convicted and sentenced to death. Now, he has a second chance at freedom. The state supreme court overturned his conviction Thursday, saying police coerced his confession.

Futrell's daughter is at a loss for words. "He clearly confessed to the crime," she told Action News by phone.

That confession is now out. Deviney's attorney told Action News, "The confession was a big part of the case. It's going to be a difficult case for the prosecution without that," said public defender Greg Messore.

Now Futrell's daughter is questioning the legal system. She has to relive her mother's murder again and hope this costly mistake by police doesn't put Deviney back out on the street.

Deviney's attorney tells Action News he'll be transferred to the Duval County jail sometime in the next couple of weeks. Then, he will be brought back here to court for a new arraignment, with a possible trial in the next two months. Futrell's daughter says she'll be there for it.

The state attorney's office says it is reviewing the opinion and will take the appropriate action.

JSO issued a statement one day after the ruling.  Sheriff John Rutherford wrote:

"I am reviewing the Court's decision and how the interrogation was conducted.  From what I've been told, I know the suspect was given his Miranda warning and never asked for an attorney.  But I want to study both the case and the decision closely, and confer with Ms. Corey because from what I know at this time, I don't believe the State Supreme Court got this one right and an appeal may be appropriate.  If we are in agreement they did not, we may need to ask another court for their opinion."

I am VERY sad, disheartened, and angry to know that my sister’s murderer has a chance at a new trial AFTER he confessed to killing her. The first words from his lawyer during the trial was that there was no doubt about his clients’ guilt. This lowlife even admitted his guilt to his mother and had the audacity to say that he thought he’d get away with it because other people have gotten away with murder. He cruelly and brutally took my sister’s life. He deserves nothing less than to be locked up like the animal he is for the rest of his life. This is a slap in the face to my family. What kind of world is this where a murder is given more consideration than he gave his victim? First he slit her throat from ear to ear and watched as she suffocated in her own blood. That was not enough for him. Then he dragged her inside, pulled down her panties, and posed her lifeless body like he raped her. Maybe he did. What kind of lowlife pig does that? The bigger question is what kind of judge looked at these facts and decided this heartless criminal deserved another chance. No second chance for the victim – DELORES ANN FUTRELL, aged 65, helpless, alone, and killed in cold blood.

I know everyone needs a job but how do people sleep at night letting vicious animal prowl the streets? This is driving me crazy!! "That confession is now out. I guess they are happy about that because to me it sure sounds like he is gloating. NO EMPATHY NO FEELINGS JUST GET THE CRIMIANL OFF AND COLLECT A PAYCHECK. I HOPE DEVINNEY AND ALL HIS LAWYERS AND THE SUPREME COURT JUSTICES ROT IN HELL. JUSTICE IS NOT BEING SERVED!!

This should have mentioned that he was read his rights but continued to talk because he wanted to find out what evidence the police had. My mother had MS and was weak and frail. She looked after this punk since he was about 5 years old making sure he was fed and got home from school safely. This is how he paid it forward. I think it is an outrage that the courts would overturn this sentencing. He CONFESSED. Its not like they beat him up or tricked him into talking. previously he went to court for a robbery and instead of the judge putting him in prison he let him back out to return 4 months later to pay restitution, which he did not have. Word is he went to rob my mother for the money. at most he got $20. He stabbed her and when she screamed he slit her throat so deep her head almost came off then he let all the blood drain out of her in her pond then he drug her in the house took off her clothes &posed her. not 1 fingerprint was found. she scratched him and his dna was in her fingernails. The police found her naked. He then came to a neighborhood vigil and told everyone the police told him she was raped and decapitated. he is a sociopath!! He laughed and joked with his lawyers the whole trial. This killed my grandmother 6 weeks later, my stepdad had an aneurism right after the sentencing hearing and is now paralyzed from the waist down, my sister died of depression last year and this has wrecked havoc on all of our family and its not over yet?? Whose side is the supreme court on???
