The trial is open to the public, understand the facts before passing judgement. I could even guess today if you were driving down the road and a jogger was in front of you, even though a sidewalk was available for the individual to use, you would try to avoid hitting him by slowing down. And also, if you car mechanic warned you that your car should not be operated at speeds above 30 mph due to safety of operation, you would probably not proceed to go to speeds of 45 mph. To add, let's assume that this is a federal regulation.

Malpractice and negligence? If anyone was negligent in this horrible incident it was the trespasser! What do people not understand about "Private Property" and "No Trespassing"?

it all depends on how you define trespassing ha ha, all the kid had to do is jump in the water like the others did, no thats to easy, instead he trys to out run a train.

So they want to sue CSX because their son is a lawbreaker and was trespassing on CSX property? Of course it's easy to get on the tracks! You can't build a fence along both sides of every track in the country!
