JACKSONVILLE, Fla -- A drive-by lie. A mother claimed her daughter was shot in a drive-by and now she's in jail for making the whole thing up.

Police say Whitney Toliver admitted to lying. She said she did it for fear of an investigation by Department of Children and Families. Neighbors around Merivale Road, where it happened, say this isn't a surprise.

Charlotte Platt keeps a close eye on her granddaughter as she plays outside. She says there's too much that goes on down the street where the shooting happened.

Police say Whitney Toliver told them someone in a Dodge Charger fired shots at the house over the weekend, hitting her 2 year old daughter twice. Days later, though, she admitted she lied about the whole thing. 

"Two year old Jontasia Miller was accidentally shot by another child while at the house," said Assistant Chief Thomas Hackney.

Detectives are still looking for the gun and weren't happy Toliver lied to them.

"The time we expended dealing with the lies the mother told us time we could've much better spend trying to recover the gun in this case," he said.

Investigators say this drive-by lie created unnecessary panic in the community.
The little girl is out of the hospital, with just a bandage on her hand. She was shot twice. Toliver is charged with filing a false report. It's a misdemeanor and she could face up to a year in jail and a thousand dollar fine. JSO says Toliver has no prior arrests.

I agree that we taxpayers should be reimbursed for the resources wasted on this. Although, people don't usually make a whole lot of money from behind bars, which is hopefully where she'll be headed, and her future jobs probably won't be to good from there either. As far as the comment about people shouldn't be making a big deal about her lying to police, I would agree if it was about something little, but how your two year old was shot isn't very little. I do agree, and have witnessed, however that many police officers lie all the time to fit their reports how it fits them best.

Being that we are in an economy where we are loosing precious services such as schools, fire, and police protection, this person's act was horrible and she should be billed for every city resource used. She shouldnt even call herself a mom! I am a TAXPAYER, and we should be reimbursed!

mom is not responsible or smart. how can a child get to a loaded weapon? she should get the max. where's the gun? the kids didn't throw it away.hospitals must report gunshot wounds so, mom lied. the gun probably isn't legal. why hide it if it is? the children should be removed and mom should go to jail and get fined to the max. she put the whole neighborhood on edge. dragster1

people are making a big deal about this lady lieing to the police and want her to go to jail for wasting time and money but when my wife and I were arrested because the police officer lied totally on the police report and nobody will do nothing about it.Thank god we had servalence cameras with sound or my wife would be on probation.this cost me $800.00,officer Wendell hit my wife and she spent 16 days in jail,plus my sons appointment for a broken wrist was missed and he had to have his arm re-broken and had to have surgery.Nothing was done to officer wendell and he still has his job.we have all the false police report from the police and videos if interested on seeing this or more info

I agree with the other two comments. What I want to know is why doesn't the mother know where the gun is? Is she covering up for someone? Even is she does know there has been plenty of time for the gun to be cleaned and polich to leave no finger prints behind. They need to remove her daughter from her and place her in a home where she will be looked after and loved. Not neglected and harmed.

Another example of the mentality in this community of deceit. Again , We need to "throw the book" at this individual. We have got to hold these people responsible for their actions and impress on them that "all" citizens must obey the law. Thank GOD that she didn't kill her child or someone else!

Go figure. Mom needs to be locked up longer than a year and fined more than 1000 for all the wasted manpower and city hours looking for the supposed drive-by shooter.
