WAYCROSS, Ga. -- The family of an 11 year-old boy is grieving tonight after he was shot and killed by a pellet gun over the weekend. The boy was at a sleep over and playing video games with his friends when the accident happened.
Mitchell Devon Maxwell, Jr. was at a friends home when the shooting happened. Three boys were playing playstation together in a bedroom. According to the Ware County Sheriff's Office one of the boys picked up what he believed to be an unloaded .177 caliber pellet rifle and pretended to shoot it. He handed it to his friend and accidentally shot Maxwell in the chest.
After the shooting happened, the boys started to panic and stop the bleeding. One of the boys notified the adults at home in the other room that Maxwell was not breathing. Stacy Chavez, 35, immediatly called 911 and attempted to perform C.P.R until paramedics arrived.
Sheriff Randy Royal said that the Georgia Bureau of Investigation crime lab in Savannah will conduct an autopsy on Monday to determine an actual cause of death.
The district attorney told Action News that currently there are no charges. A 12 year-old is too young to be charged in Georgia. Additional action could be taken in juvenile court at a later time.
