State not appealing ruling over Fernandez statements

JACKSONVILLE, Fla. -- The videos showing the interrogations of Jacksonville's youngest murder suspect Cristian Fernandez will be kept out of the trial.

The State Attorney's Office says it will not challenge the judge's ruling.

Early last month, Judge Mallory Cooper granted a motion to suppress three post-Miranda statements, including police interrogation videos and statements he made at a time when he was in the same room as his mother.  Attorneys for Fernandez argued he didn't understand his Miranda rights.

Fernandez, 12 at the time of his arrest, will be back in court on September 28.  He's accused of beating his 2-year-old brother to death in 2011.  He's also facing charges of sexual abuse on a relative.
