Saw the report tonight on the backlog of VA benefits claims for disability. Action New's statement, “The backlog of benefits claims is downright ugly in our area. Local vets waiting on average of hundreds of days.” We have been waiting on an appeal since 2007! My husband is a DAV and was given a Honorable Discharge and small medical compensation disability in 1976. He never complained or asked for an increase. That is until his condition go worse and has caused secondary problems due to his service connected injury. Reports from VA and private side doctors submitted supported his claim for increase in compensation, as likely as not his service connection injury has aggravated and has caused some of the secondary problems he was denied an increase. After filing an appeal, Washington VA Hearing board reviewed the claims found some supported facts not consider on the Regional Level and sent claim back to Regional Office Jurisdiction in St Petersburg, FL to be reconsidered. Now we are waiting to be scheduled a hearing with the ROJ. Appeals that he filed in 2007! We are told by VA when we check the status on claim. “the VA Hearing Board only comes around at certain times, and Vets must understand it can take up to 2 years to get a hearing scheduled.” Hello, VA it has been over 2 years! So we sit and we wait for a hearing to get scheduled. My husband can no longer work due to medical condition and was forced to apply for Social Security disability and by the way was approved for.

I am US Navy desert storm veterans disabled from service. Have blood enzyme condition that is vulnerable to vaccines and chemical spills/ weapons. I was exposed to both in military, especially during desert storm. While the VA approves most desert storm veterans cases they refuse to approve mine stating being off the coast of Isreal I am not covered even though my ship hit targets in Iraq, even though I am vulnerable to chemical weapons and vaccines including anthrax. The VA maintains that even though scuds landed in vicinty of my ship ( a fast attack sub) and said ship ingested sea water that I will never be service connected. The VA also maintains that other vets who did nothing more than fly out of Saudi airports will be service connected for being sick. I have requested a jury trial for my case when it gets to VA court as I have extensive evidence to present. I am told that will never happen veterans are not citizens but property that may not REQUEST or demand a jury trial to decide their disablity case. I can prove my case to a jury however I am told by many lawyers I will lose my case when it goes to VA court system not because I am lying but because the way the law is written. I wrote to both Bill Nelson and Rubio about this. Nelson investigated then dropped it when seen how it showed the US in bad light to watch actually happened to desert storm veterans. I never heard from Senator Rubio office. Next time you tell people thank you for service rember vets from atomic age up were used as guinea pigs and some them never receive disabilty or justice for what was done to them by the government. Many who have seen my evidence gasp about how extensive it is and proves my case. To bad the judges at the VA could care less about truth or justice.
