Video released of middle school beating

JACKSONVILLE, Fla. -- Video of a brutal beating involving local teens is making national headlines, and Action News has obtained that video.

The beating sent Aria Jewett to the hospital with a fractured skull.

It's clear in the video the attacker, who has been labeled a serial bully, is the only one throwing punches.  Jewett crouches on the ground trying to escape, but never really fights back.

At one point you can even hear what sounds like laughter from a group of kids who gathered to watch. 

The alleged bully has been charged.  Two others have been named co-conspirators.  A judge permanently banned the alleged attacker from all Duval County schools.  But last week, a Florida Appeals Court temporarily halted that ban while this case works its way through the court system.

Jewett's attorney John Phillips Tells action news he agreed to the temporary ruling -- saying there are complicated and important issues at play but says the judge's initial decision sent a message to the alleged bullies.

The 14-year-old suspect is charged with aggravated battery in juvenile court.  Phillips says the two co-conspirators, including one who did the videotaping of the fight, are just as guilty as the girl throwing the punches.

There is MORE to this story after doing some minimal digging on the internet it appears the "victim" is NOT exactly a victim after all: According to various web sites Aria the "victim" was actually FRIENDS with the "bully" the FIGHT was over a facebook dispute. And if you don't believe me see for yourself, check out Aria's community page she refers to female classmates as "b*tches" and "hoes" this community page was started in FEBRUARY! Does this sound like a victim to you? someone who provokes classmates? Someone who uses "information" she was possibly privy to when she was OK with said behavior because they were friendly? Where is the proof that the bully recorded multiple attacks? Or are these more lies? As promised I have proof for you that Aria Jewett is NO victim here. Why can't the bully student be sent to the high school at the Job Corps located in Jacksonville, FL? She would fit right in there. I worked there for three months as an academic supervisor, and was attacked three times by those darling students. All I needed to do my job was a chair, whip and a loud whistle. I was laid off because a student said that I cursed at him after he punched me in my face and kicked me in the head. As I said, that female bully would receive a wonderful education with others who are of like mind and personality.

Lock her up and sew it up so us taxpayers do not have to pay her welfare benefits when she gets pregant and has kids, she is like the rest of them, have kids, don't work, steal from everyone else and expect everyone else to support them, her parents are worthless for not raising this kid and parenting the way they should, they were at target stealing goods to support their drug habit!

Sadly the judge had not jurisdiction to expel the student from the district and that is why the appeals court overturned the decision. This crime happened outside of the school, the girl left campus with someone and was setup. because of this the school is not able to expel, suspend, or in anyway discipline the child at school unless (or until) she is charged by the court. Page 34 of the Duval Student Code of Conduct states: FELONIES COMMITTED BY STUDENTS Following appropriate due process procedures, a student charged with a felony or delinquent act that would be a felony if committed by an adult, whether it occurred on or off the school property, may be assigned to an alternative program or receive alternative educational services. Such assignment may be made upon determination that the student is eligible according to federal and state program criteria, and: ? The nature of the offense is such that the student poses a threat to safety of other students or personnel at school. ? The student’s safety is at risk by remaining in school with other students. The recommendation of the principal to exercise this policy must be approved by their Chief Officer. There's no other statement in the COC that states that there should be discipline for any off campus act (except for hazing). We as parents need to read the things the school sends before signing it because in situation like these there is really no recourse besides court but a judge can not take a student out of a school unless there is a restraining order. School board policy needs to be changed to include off campus acts of violence. The student should not have to be charged with the crime first before action is taken, if there is video evidence, or a verbal admission.

Before someone is killed, someone needs to file a law suit. If I were this child's parent, I be talking to an attorney and sue EVERYONE involved.
