JACKSONVILLE, Fla. -- The case against Jacksonville's youngest murder suspect is about to move forward.
Cristian Fernandez is expected to be back in court Monday morning for a pre-trial hearing.
Fernandez is charged with first-degree murder in the death of his youngest brother David. David was 2-years-old when he died of severe head trauma. Investigators say he was in Cristian's care at the time those injuries were inflicted.
Cristian, who is now 13, is the youngest person to be tried as an adult for murder in Jacksonville's history. He is also facing unrelated child sex abuse charges.
Bianella Susana, Cristian's mother, was scheduled to be sentenced last week, but her sentencing was postponed to January 8, 2013.
Cristian's original pre-trial date was supposed to occur the same day, but was also postponed because one of the attorney's in the case was unable to attend.
Susana pleaded guilty to aggravated manslaughter and faces 30 days in prison for waiting many hours to call for help for her dying son.
The Fernandez pre-trial hearing is scheduled for 9 a.m. Monday.
