Accused child killer Donald Smith in protective custody

JACKSONVILLE, Fl -- The man accused of kidnapping and murdering 8-year-old Cherish Perrywinkle is being kept in protective custody inside the Duval County jail.

This means he is being kept out of the jail's general population.

Action News asked JSO if Smith was on suicide watch but officers would not give us that information.

Action News also asked why Smith was dressed differently than other Jacksonville inmates when he made his first court appearance on Sunday.

In video from Sunday, Smith wore a red jumpsuit. The Jacksonville Sheriff's Office says 'high profile' inmates are dressed in red so they are quick and easy to spot in court and inside the jail.

Action News also asked whether Smith had any visitors.  So far, he has not, according to JSO.

Smith pleaded not guilty to charges including murder and kidnapping at a first appearance on Sunday. He was denied bond. His next appearance is set for July.

JSO says Perrywinkle was kidnapped late Friday night from the Northside Walmart off of Lem Turner Road. He was arrested Saturday, June 22, along I-95 just north of the I-10 split after an officer spotted his van.

Police say a woman first spotted the white van driving suspiciously near the Highlands Baptist Church on Broward Road. Within an hour of Smith's arrest, officers found the little girl's body in some woods behind the church.

Officers have not released how she died or what they believe Smith was doing from the point of the abduction until his arrest.

She saw that her mother was accepting of him and what he was supposedly 'giving' them…Mom obviously felt comfortable with this predator, and so the child felt comfortable too. Mom DID allow this to happen!!!!!!

That's not how it was reported jaxguy. She was befriended in the family dollar by this proclaimed 'family man'and was told he could help her out with clothes with a walmart 'gift card'when his 'wife' brought it to him. When she went back to shopping he walked away saying he was going to Mcdonalds, he was hungry, would they like anything?. Someone said a 'cheeseburger'., I guess that was Cherish. When the mom turned around she realized Cherish had went with him. This pos took her straight out the door, not to McDonalds. Thats when the mom started looking for her and 911 was called. The only thing I feel this mom did wrong was NOT teaching her children To NEVER GO ANYWHERE WITH A STRANGER, NO MATTER HOW NICE THEY SEEM. She could not have known this pos would be this BOLD to do this with this many people around. She did not ALLOW her to go with her, is what was stated.

i think something should be done to the mother for allowing her child to leave with a stranger. Smith did not kidnap her he told the stupid mother he was going to buy her some clothes... I think there's more to the story.

I think that the mother needs to be charged with something. According to the report she met this man at the dollar store and got in the car with him, with her children. This to children makes it okay, if the mother did not think anything was wrong with him then the children trusted him as well. This woman was in a custody battle with the father over this one child and let the child go with him. This was a senseless killing that never should have taken place and my heart goes out to the child, the rest of the children and the father of Cherish. My thought is if this is how she takes care of one what is going to happen to the others. She never should have gotten in the car with a stranger. This is not 1960. Why isn't the police going after her for putting her children in harms way? There are a lot of people who feel that she was just as much to blame. Children look to their parents to indicate if things are okay and she let this child down. I know God has this child but it really makes me mad when she is not taking responsibility for any of this.

While it is pretty obvious he is guilty should give him chance to prove his innocence. A person can be in the wrong place at the wrong time though I seriously doubt he is innocent. Once it is proven he is guilty bring by the electric chair for these unholy monsters. You rape and murder someone you get 3 death sentences provided it can be proven beyond a reasonable doubt you did it.

It's like the old saying goes, don't do the crime if you can't do the time!! He deserves to be with the general population, why should he get special treatment? Last time I checked you loose all your rights as a U.S. Citizen once you are in jail.
