JACKSONVILLE, Fla. -- An Florida Appeals Court has stayed a countywide ban on a 14-year-old Oceanway student accused of bullying a fellow classmate.
John Phillips, the victim's attorney, says the appeals court has not reversed the Duval County decision, but has temporarily halted a ban on the student attending schools in the district.
Phillips says "The appeals court issued a very temporary stay of the complete ban from Duval County schools until it can be worked out through the courts. We actually agreed to the temporary ruling. There are very complicated and important issues at play. Nothing was reversed. The suspect can't go to Oceanway, but can resume school in Duval County until we can formally hear the issue. As we've said from the beginning, the judge went further than we requested, sending a message to the bullies and system."
The 14-year-old suspect is charged with aggravated battery in juvenile court.
