Juror excused in the mass murder trial of Guy Heinze, Jr.

BRUNSWICK, Ga. -- A juror in the mass murder trial of Guy Heinze, Jr. has been excused. A judge excused the juror just after 10 a.m. Friday during the third day of jury deliberations. The judge would not say why the juror was removed from the case.

Deliberations must now start from the beginning. The jury must be unanimous in deciding whether Heinze is a mass murderer or a young man wrongly accused.

Mistrial means the past two weeks have been all for nothing. If the jury cannot reach a decision, Heinze will likely go back to jail and wait for another trial.

Heinze, 26, is charged with eight counts of murder. Prosecutors say he killed his family, beat them to death inside the Brunswick trailer they all shared back in August of 2009.

Thursday the jury told a judge they had reached a verdict on drug charges against Heinze, but were split 9-3 on the murder charges against him.

No definite murder weapon has been identified. No clear motive has been established.

Experts for the defense testified more than weapon was used. They said there had to have been more than one killer and that Heinze wasn't one of them.

Heinze faces the death penalty if convicted. We have a crew inside the courtroom. We'll let you know as soon as a decision is reached.
