JACKSONVILLE, Fla.-- First, it was Christmas lights. Now, it's the American flag. Again.

"It's like instant replay. $100 a day if you don't take it out," Larry Murphfree said.

Murphfree has been fighting his HOA in the Sweetwater community for years. He says every time he turns around, he's being harassed or slapped with a notice. After he filed a lawsuit last year, the rules were reworked and neighbors gained a small victory. Flags are allowed to be hung on the outside of the buildings in a holder.

The problem came when Murphfree decided to put a small one in his flowerpot this week. His daughter lives in Oklahoma City, and he wanted to stand united with that area after the tornado.

"There's a picture. Showed a concrete slab where a house used to be and the only thing standing was a tattered American flag," he continued.

Murphfree and his attorney Gust Sarris plan to file another lawsuit early next week. Sarris says they have no choice.

It's one of those things, if you don't fight for your rights, sooner or later you use them," Sarris said.

We tried reaching out to Continental Group -- the HOA behind the fines, but got a message that they were gone for the Memorial holiday weekend. Murphfree says he's not giving up his stars, stripes or anything else he's entitled to.

I stood up to them last year. I'm going to stand up to them this year," he said.

State and federal laws say Homeowners Associations are not allowed to dictate where and how to fly the American flag.

These HOA's don't give a hoot if they are sued, just ask Trayvon Martin's family, They got millions even though Zimmerman hasn't even had his day in court yet to prove he was defending himself against a 'thug'. And the HOA's was allowing this thug to 'stay' at his relatives house and run the streets of that housing developement. That in itself should have been breaking a bigger 'rule' than some Veteran flying a flag. Go figure, HOA's just a bunch of crooked thieves.
