Marissa Alexander bonds out of jail

JACKSONVILLE, Fla -- The Jacksonville mother convicted of shooting at her estranged husband has bonded out of jail.

Marissa Alexander was released just before midnight Wednesday. She is now under house arrest.

Alexander is awaiting a new trial for firing two shots near her estranged husband.

A judge ruled in September that Alexander would receive a new trial due to bad jury instructions given in her first trial. 
        
Alexander and her attorneys say she fired the gun as a "warning shot."


Statement from State Attorney's Office

“The State Attorney’s Office made all statements regarding its position on bond in its written response dated November 13, 2013. The SAO will continue to seek justice for our two child victims and their father who were endangered by the shot the defendant fired at them. Any further comments regarding the prosecution of this defendant will be made in the proper venue – the courtroom.”

if she feared for her life she should have shot him and not the ceiling. Oh i forgot she left the location of the altercation when and knowingly retrieved a gun came back in and fired a warning shot. Warning shots are threats under all Stand YOur Ground or fear for your life. She is guilty and that will all come back out in March.

Here are just SOME of the laws she has broken... 790.19 Shooting into or throwing deadly missiles into dwellings, public or private buildings, occupied or not occupied; vessels, aircraft, buses, railroad cars, streetcars, or other vehicles.--Whoever, wantonly or maliciously, shoots at, within, or into, or throws any missile or hurls or projects a stone or other hard substance which would produce death or great bodily harm, at, within, or in any public or private building, occupied or unoccupied, or public or private bus or any train, locomotive, railway car, caboose, cable railway car, street railway car, monorail car, or vehicle of any kind which is being used or occupied by any person, or any boat, vessel, ship, or barge lying in or plying the waters of this state, or aircraft flying through the airspace of this state shall be guilty of a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 790.233 Possession of firearm or ammunition prohibited when person is subject to an injunction against committing acts of domestic violence; penalties.-- (1) A person may not have in his or her care, custody, possession, or control any firearm or ammunition if the person has been issued a final injunction that is currently in force and effect, restraining that person from committing acts of domestic violence, and that has been issued under s.741.30. 790.10 Improper exhibition of dangerous weapons or firearms.--If any person having or carrying any dirk, sword, sword cane, firearm, electric weapon or device, or other weapon shall, in the presence of one or more persons, exhibit the same in a rude, careless, angry, or threatening manner, not in necessary self-defense, the person so offending shall be guilty of a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083. 790.161 Making, possessing, throwing, projecting, placing, or discharging any destructive device or attempt so to do, felony;

Supposedly excerpt of her husband deposition" Once he managed to get inside, he said he pushed her into the door with enough violence to further damage the door. Did you put your hands around her neck? “Not that particular day. No.” They struggled. She ran out through the laundry room into the garage. “But I knew she couldn’t leave out of the garage because the garage door was locked.” She came back, he said, with a gun, yelling at him to leave. “I told her I ain’t leaving until you talk to me, I ain’t going nowhere, and so I started walking toward her and she shot in the air.” “I start walking toward her, because she was telling me to leave the whole time and, you know, I was cursing and all that.” His two sons by a previous marriage were in the room. “If my kids wouldn’t have been there, I probably would have put my hand on her. Probably hit her. I got five baby mommas and I put my hands on every last one of them, except for one. I physically abused them. Emotionally. You know.” “I honestly think she just didn’t want me to put my hands on her anymore so she did what she feel like she have to do to make sure she wouldn’t get hurt, you know. I have read about the abuse she says he inflicted on her. Was it physical? Are there police reports or hospital visit due to it? Didn't she retrieve the firearm from her car that was in the garage? She had the option of not returning to the house and fire that "warning" shot. I endured emotional and physical abuse by a boyfriend decades age. I know first hand what it feels like to be in this position. By God's grace and mercy, He provided the path for me to leave it. Also blessed there were no children dragged into that mess. Does she deserve jail time? According to the law, she does. IF she has a paper trail of said abuse, her lawyers can use the abuse defense. Some are quick to slam the SA for the botched trial, but it was the judge that made the mistake with instructions to the jury. Now there will be another trial. Should be interesting. Also, how/where did she come up with 10% of her bail? Over $25,000. I will say I am glad she is out on bond & having the holidays with whomever. Hopefully she will honor it and stay away from the ones she shot at.

Should notice that prosecutors are still out to ruin this woman and put her in jail. Her husband has threatened her as well as has beat her in the past. Yet they feel she should be behind bars for 12 years because she fired a warning shot. She did not plan to shoot her husband but a confrontation did occur that put her in harms way. She should get probation and have her right to carry a fire arm removed for say 15 years. She is not the type person who has robbed a store, pistol whipped someone, or assaulted them while brandishing a gun. That is what the minimum 12 year sentence should be for. The prosecutors office just does not get it. Corey and her bunch should be made answerable both to the Bar and the people. Action news should do special on what it takes to remove corrupt prosecutor's who lie and hide evidence from the people from office. In the Travyon Martin case we found out his back ground showed he was criminal likely to attack anyone who ticked him off. That he disliked snitches and felt they should bleed. Was caught with stolen jewelry and given a pass. Bragged about assaulting people and much much more. Marissa Alexander is simply guilty of trying to stand up for herself from an abusive husband. Any person who is constantly abused will lash out in defense after awhile. Keep that in mind when you let the prosecutors office put her behind bars with robbers and thieves who use guns.
