JACKSONVILLE, Fla. -- Police say Herman Pickens, the suspect charged in the shooting at a CVS Pharmacy this week, is also being held as a suspect in the fatal shooting at Mojo No. 4.

"We have the right person in custody," said JSO Chief Annie Smith.

The shootings happened Monday morning.

A man with a gun shot and killed 53-year-old Robert Sutton at the restaurant.

Not long after that, police responded to another robbery and shooting at the CVS Pharmacy in Ortega. The victim was grazed by a bullet.

Police shot Herman Pickens Tuesday afternoon after a short pursuit on the Westside.

Detectives had him under surveillance until he rammed a car at Jammes Road and San Juan Avenue, before running away.

Police said Pickens ran into a nearby restaurant, reached into a black bag when officers shot him. JSO said officers found a gun in the bag.

Pickens had been in the hospital for most of the week. JSO did not say whether he was still hospitalized.
