Teen killed: Suspect waives court appearance

JACKSONVILLE, Fla.-- Michael Dunn has waived his court appearance in the shooting death of a teen at a local gas station. Dunn is facing second-degree murder and attempted murder charges in the shooting death of 17-year-old Jordan Davis. The charges could be upgraded to first-degree murder, if the State Attorney's Office can prove the shooting was premeditated.

Davis was shot and killed at a gas station on the Southside Friday night. Police say an argument over loud music ended with Dunn firing several shots into an SUV carrying Davis and three of his friends.

According to Dunn's attorney Robin Lemonidis, her client did nothing wrong.

"They were blasting some rap music and he said, he rolled down his window, he pulled up on the passenger side, and rolled down his window and said, would you mind turning that down? And said it very politely," she said.

From there, Dunn claims he felt threatened, so defended himself the best way he could.

"And that's when the guy in the back seat raised the barrel of a shotgun over the rim of the window", Lemonidis continued.

Dunn is claiming self-defense, but police say no gun was ever found in the teens car. Now, it's up to the legal system to sort everything out. Jordan's parents pray for justice and change so something like this never happens again.

"I will never understand how he believe he felt threatened by them. They're in the car. There's no guns, no weapons, there's nothing," mother Lucia McBath said.

Dunn is scheduled to be back in court December 19th.

First off NO ONE knows exactly what happens but I think it is a little stupid to shoot into a vehicle every one says what a good gun would do if felt threaten. Well I see NONE of you have taken a gun safety class or even applied for your Gun License. The first thing they teach is not to use a weapon to threaten or scare someone. What he was playing loud music so that was a threat should have minded his own business. Now Mr. Dunn you claim the kids had a shot gun if that had been so you would have stuck around for JSO but instead you had to run and make up a story guess the tooth fairy came down and took the so call shot gun your mind was seeing. Stand your ground is only good if there is a weapon found. You must not have been threaten to bad it took time for you to reach in your glove box to retrieve the weapon and then took time to load it you must think everyone is stupid, You just think you can make it all look good all for you well I am sorry you are a coward just like the cowards who ran down a bicyclist and keep going guess they will say they felt threaten he pull his bicycle out on them. Mr. Dunn how would you feel if someone pulled up to your son and because his music was not to their liking so they shoot him down for his music REALLY

This is a racist hate crime. It was also sensless.. He claim they had a shot gun but if i had a gun and someone waas shooting at me ima shoot back i have the right too...

Had this been a middle-aged black man who shot 8-9 rounds into a vehicle full of white teens, killing a 17 year old white high-schooler, I think your opinions would be different, 1country and makanik. From every angle I have read and through my own research of Mr. Dunn, he sounds like an fairly wealthy arrogant redneck. If I had to guess, I would say that Mr. Dunn was mostly likely drunk. He just came from his son's wedding and his girlfriend was in the store to purchase alcohol (I'm sure some really classy wine from the Gate station, btw). He decided to complain to the teens for blasting their music. They acted like teenagers typically do by mouthing off to him and turned it back up. The drunk Mr. Dunn, having felt emasculated by a bunch of teens, went back to his car, got his gun, and shot at them. He then, like a coward and not a responsible citizen or gun owner, drove back to his hotel, slept off the alcohol, and drove back to Brevard County. Unforntunately, there were witnesses so he was easy caught once he was back home. And to blame the Gate employees? Don't you think they were busy enough on a holiday weekend evening? It is also not their job to enfore loitering statutes. And who ever said the teens were loitering? Perhaps they stopped by the store too, just like Mr. Dunn. He let his anger get the best of him. Yelling at the teens was enough, but brandishing a weapon and shooting at them, resulting in loss of life? That is outrageous. He is an arrogant redneck and deserves every bit of punishment the law will give him. I'm not a proponent of the death penalty, but had this been a black man, I'm willing to bet that most of the rednecks out there would be wishing Old Sparky was still up and running. To even try to defend Mr. Dunn is ridiculous and to insinuate that he did anything right during this incident is pure insanity. Please face reality and realize that he is an arrogant fool and don't place blame on the teens or anybody else.

Makanik, why do you assume that black people have rap sheets? How come you aren't asking to see Michael Dunn's criminal record? I guess only black people loiter at stores, even though in all the news reports there have been no mention of "thugs hanging out harassing people". I've said it before and I'll say it again. "Welcome to Jacksonville....the largest trailer park in the world" It's racist people like you that make the rest of us educated people look bad. Why don't you crawl back under your sheet, I'm sure you have a cross to burn somewhere. But I'm sure you are only saying the hate filled speech because you can do it anonymously. If you had to post your real name, you would probably would be a coward.

Last time I checked it was not against the law for blacks to go into a store to make purchases! What this man did was wrong on so many levels. Who has not been annoyed by cars blasting any types of music? Normal people just leave. I guess when white kids start getting killed by gun carrying black people is when you all will start wanting changes.
