Expert: Driver involved in crash that hurt children likely won't face charges

JACKSONVILLE, Fla. — The driver of the car in a crash involving children likely won't faces charges, even with children not wearing seat belts, according to Action News Jax Law and Safety expert Dale Carson.

A 7-year-old is in critical condition after a crash on Jacksonville’s Westside Thursday night.

There were seven people inside a Chevrolet Camaro that was involved in the crash, and five of them were children. Two children involved in the crash were not wearing seat belts, according to authorities.

The grandmother of those children told Action News Jax that her daughter was the one driving the Camaro.

“We do have people who have been involved in traffic accidents where someone has died as a result of their carelessness, but they’re never charged criminally,” said Carson.

Carson said the driver will likely face two civil citations -- one for careless driving and the other for the seat belt violations.

“If alcohol is not involved and the individual is not driving recklessly, fast, weaving in and out of lanes, things of that nature, there will simply be a civil citation issued for careless driving,” Carson said.

The grandmother said the driver of the cameroa is recovering from a head injury.
