Jacksonville man from Bosnia suing over placement on 'no-fly list'

A Jacksonville man is suing the government in federal court because he said he was wrongfully placed on the no-fly list.

Zijad Bosnic, an American citizen from Bosnia, brought the complaint to the U.S. Courthouse with his attorneys Thursday afternoon.

Lena Masri, the national litigation director at CAIR, the Council on American-Islamic Relations, is helping represent him.

“[Bosnic] was added to the no-fly list after he left the country, and as a result, he was essentially stuck in Bosnia and unable to return home since March,” Masri said.

CAIR said Bosnic just returned Wednesday night on a one-time waiver.

CAIR said because of the designation, Bosnic can't see his family in Bosnia or do his job as a truck driver.

“His transportation worker identification credentials were suspended as a result of being on this no-fly list, so he's effectively unable to work because of this placement," Omar Saleh of CAIR said. “He's never been arrested, charged with, or convicted of any crime.”

But CAIR isn’t just trying to get Bosnic off the no-fly list; they’re challenging the list itself.

They want it thrown out and deemed unconstitutional.

Action News Jax law and safety expert Dale Carson doesn’t believe either will happen.

Carson said Bosnic has exhausted all he can do by first challenging his designation with the Department of Homeland Security.

Action News Jax reached out to the federal agencies named in the complaint, but they will not comment on pending litigation.
