The trial for the man accused of killing Cherish Perrywinkle has been moved.
Defense attorneys asked for the trial of Donald Smith to be moved from October due to issues with the trial being a death penalty case.
A judge set a tentative date of Jan. 20, 2015.
Police say Smith kidnapped the 8-year-old girl from a Walmart store on Lem Turner in June 2013. Police found her body behind a church the next day.
Smith is a registered sex offender.
He will be back in court in November for a pretrial hearing. One item up for discussion is a computer that has yet to be confirmed as evidence.
