JACKSONVILLE, Fla. -- An evidence hearing is underway for Cristian Fernandez; and it brings into question the rights of a child when it comes to what he says to others.

Attorney and Former FBI Agent Dale Carson explains the laws surrounding this situation and what they could mean for Fernandez's future.

Here you are talking about a 12 year old child knowing his legal rights when talking to the police. I am 55 and I myself do not understand all of legal ways that things should be done. When you are not accustom to being in trouble and not having to deal with the legal system, how would you understand what all of that mumbo jumbo they be saying right or wrong. IJS

Christian Fernandez is A CHILD. Think about it ..... is YOUR 12/13 year old old enough to understand politics and ALL LAWS ? NO they are NOT !!!! This is a child of God too, if we (FLORIDA) allow the Jails/Prisons to RAISE this young boy, then he will NEVER REHABILITATE from that type of distruction, EVER !!! The correctional institutions in America DO NOT REHAB PEOPLE, it teaches criminology, and sex crimes, and murder.
