Judge: Wisconsin home bakers free to sell to public

MADISON, Wis. — Wisconsin’s cake and cookie makers had their day in court Thursday, and were treated to a judge’s decision that found the restriction on selling home-baked goods in the state was unconstitutional.

Before that decision by Lafayette Circuit Judge Duane Jorgenson, Wisconsin was one of two states that forbade home bakers to sell their products without a food processing plant license, WITI reported.

Officials with the Wisconsin Department of Justice confirmed that home bakers may sell their goods without a license, WITI reported.

Jorgenson clarified his May 31 ruling because Wisconsin officials argued that the ruling was limited to three specific bakers who teamed up with the Institute for Justice in January 2016 to challenge the ban. Thursday, Jorgenson ruled that his decision applied to all home bakers statewide.
