7-year-old Jacksonville boy's shooting death ruled "justifiable" by State Attorney's Office

Investigators consider the shooting death of 7 year old Tashawn Gallon as justifiable.

The young boy was killed during a shootout in February of 2018, JSO says a family member accidentally killed Gallon.

Gallon was in between two groups exchanging gunfire at a home on Mt. Herman street, police say a van pulled up to the home and began shooting.

A family member of Gallons returned fire, one of the bullets striking him in the head.

Newly released documents reveal a possible motive, and a list of possible shooters during the shoot out.

Silas Ervin who was killed April of 2018 is listed as a potential shooter, and JSO says he may have been upset over the murder of a person who goes by Treasy, and it possible developed into a retaliation effort. ​

According to the State Attorney’s Office,  the shooting death of a Jacksonville 7-year-old has been ruled "excusable," meaning without intent by the shooter and no one is facing charges.

Action News Jax reported last February when Tashawn Gallon died after getting caught in crossfire between two groups of people while standing in the front yard of a Durkeeville home.

The Jacksonville Sheriff’s Office says the case has been cleared as an excusable homicide. According to state law the legal definition for an excusable homicide is when committed by accident and misfortune in doing any lawful act by lawful means with usual ordinary caution, and without any unlawful intent, or by accident and misfortune in the heat of passion, upon any sudden and sufficient provocation, or upon a sudden combat, without any dangerous weapon being used and not done in a cruel or unusual manner.

Donald Foy with MAD DADS held a community walk shortly after Gallon’s death. He says he believes someone in the community knows something, but hasn’t come forward yet.

“We want somebody brought to justice for this.” Foy says.

JSO says they are planning on releasing more details on the case at some point Tuesday morning and we’ll bring you an update once we learn more.
