NASSAU COUNTY, Fla. — State attorneys in Nassau County are challenging a new claim that accused killer Kimberly Kessler, is incompetent to stand trial.

On Thursday, Kessler’s defense attorney presented the court with a new motion, a doctor’s note that claims Kessler is incompetent to stand trial based on the doctor's evaluation.

Kimberly Kessler is accused of killing Joleen Cummings, ofNassau County, whose family was in court for part of the proceedings.

The State requested a motion to have another physician examine Kessler on her competency to stand trial.
A Nassau County judge passed the case to June 27.
