"So sorry that I couldn't do more to save him." Good Samaritan speaks out about San Marco murder

JACKSONVILLE, Fla. — Watch Action News Jax live at 5 p.m.:

A man shot and killed at a San Marco hotel was not the intended target, according to the Jacksonville Sheriff’s Office.

JSO has now charged 48-year-old Andre Burkes with the murder of 52-year-old Timothy Tyson.

The shooting happened on Jan. 29 at the Scottish Inn on Philips Highway.

JSO said witnesses came forward to help solve the crime.

The sheriff’s office said Tyson was sitting in a vehicle when he was hit by a bullet that was not intended for him.

JSO said Burkes was aiming for someone else during an argument.

Witness Darrin Boswell said he was in his room at the hotel when he heard the gunshot that took Tyson’s life.

Boswell said he called 911 and tried to keep Tyson alive until the ambulance got there.

“I said, ‘Go grab me some ice and some rags, and hurry up,’” said Boswell. “I got him to where he was breathing. And I got him to where he looked at me one time. And somebody called him Tim. So, I assumed that was his name. I was like, ‘Tim, Tim, come on, buddy. Hang on, hang on, hang on. Ambulance is on their way,’” said Boswell.

Tyson died at the hospital.

"All I can keep thinking about is, these people are out randomly shooting people and now this fellow just died for no reason. Because some idiot wants to pull out a gun and start shooting people," said Tyson.
Burkes was also charged with possession of a firearm by a convicted felon.

It’s his seventh arrest in Jacksonville.
