Oakleaf student allegedly questioned at school without parental consent

The parent of an Oakleaf elementary school student contacted Action News Jax after he said his daughter was questioned by police on school grounds but was never notified.

Jeremy Chinchilla said his daughter was interviewed about another student allegedly talking about a shooting.

Chinchilla said the school never notified him about the interview he said took place.

Action News Jax Law and Safety expert Dale Carson said parents don’t have a right to be with their student during a police interview conducted in school and parents don’t have to be notified.

If a child requests a parent during the interview, questioning should cease, according to Carson.

“It's much easier for police to take the child absent from parent notification or involvement and solicit the truth from the child," Carson said. "You don’t have any right to be present during the interview or protect the interest of your child."
