Trial for Cherish Perrywinkle's accused killer delayed until October

JACKSONVILLE, Fla. -- The trial for Cherish Perrywinkle's accused killer is delayed until October.

The trial for Donald Smith, a registered sex offender, is delayed until October. Smith was in court Wednesday morning. 

Smith is accused of abducting and killing 8-year-old Cherish Perrywinkle last June. Police said Smith kidnapped Perrywinkle from a Walmart on Lem Turner Road that month.

Smith's trial was supposed to begin in May.

Jury selection will begin on Oct. 6.

The State Attorney's Office is seeking the death penalty for Smith.
