Family of man who went overboard on cruise ship says video proves he didn't jump

JACKSONVILLE, Fla. — The family of the man who went overboard on a Royal Caribbean cruise says they have new video that proves he did not jump off the boat.

The cellphone recording was made just hours before he fell off the ship.

It's a cellphone recording between that man's husband and the cruise security. Bernardo Elbaz's family says the couple was upset about how they were being treated for recording other parts of their trip and tried to explain to security they weren't doing anything wrong.

“I am not a pedophile. I have a husband. I record wherever I go -- except in the casino, because that's international law. You can't record in the casino,” Elbaz says during the cellphone video.

The family's attorney said the ship's security took the phones from Elbaz and his husband. Cellphones recorded Elbaz clinging to a life raft as other passengers tried to pull him up.

His family's lawyers said this was an act of protest against the way he was being treated and not a suicide or a domestic dispute.

The 35-year-old fell off the ship, and his body was not recovered.

The Broward County Sheriff's Office says it’s investigating but has not issued any blame.

The attorney for Elbaz said he is looking into what he considers possible negligent rescue efforts.
