ST. JOHNS COUNTY, Fla. — The Florida Department of Law Enforcement said special agent Rusty Rodgers who investigated the death of Michelle O’Connell demonstrated "sub-standard" performance.
O’Connell died in 2010. Officials deemed her death a suicide; however, her family maintained that she was killed by her by boyfriend and St. Johns County Sheriff’s Deputy Jeremy Banks.
FDLE determined that Rodgers demonstrated "sub-standard" performance during his investigation O'Connell’s death, according to officials.
Rogers is going to receive remedial training and increased supervision in the future as a result of the investigation, SJSO Sheriff David Shoar said.
“I am pleased that FDLE has resolved this case concerning Rodgers' conduct, identified issues concerning his performance and that they have implemented an action plan to address their concerns,” Shoar said.
Swearingen indicated that Rodgers would not be assigned any criminal investigations in St. Johns County in the future, Shoar said.
Shoar said the only aspect pending is the resolution of the federal civil rights case that Banks has filed against Rodgers.
Family had requested private autopsy done, and the body was exhumed in Jan. 2016.
