JACKSONVILLE, Fla. — A judge denied a stand your ground hearing for Marissa Alexander.
Circuit Judge James H. Daniel said Alexander "has not demonstrated that the material facts and evidence in this case have changed since the first hearing so as to raise new issues not addressed by the trial court in the first hearing and the appellate court in its prior decision."
"We have received Judge Daniel's order and are in the process of reviewing his decision. We deeply appreciate the time and thought that Judge Daniel continues to give to the numerous complex and difficult issues in Marissa's case," said her attorneys Buddy Schulz and Bruce Zimet.
Alexander is facing a new trial on aggravated assault with a deadly weapon charges after her previous conviction was overturned by an appeals court. That court found the trial judge issued faulty jury instructions regarding self-defense.
