DUVAL COUNTY, Fla. — The State Attorney's Office announced the June fatal shooting at Nippers Beach Grille is justified.
The Jacksonville Beach shooting in late June killed Black Piston biker Zachariah Tipton.
Corey said based on the surveillance video, it appears to have been a planned confrontation on another biker at the restaurant. That biker, Kristopher Stone, was a member of the Iron Order.
The other victim in the case suffered a broken nose during the confrontation and told officers he was in fear of his life. Corey said more than one person beat Stone.
It was not murder because it is justifiable use of force in Florida law, said Corey. Based on the facts and the law, Corey said, Stone is not facing any charges in this crime.
(Editor's note: An earlier version of this story incorrectly stated that Stone was a member of the Outlaws.)
