JACKSONVILLE, Fla. — Kevin Wilcoxen returned to court Friday, one month after he was convicted of aggravated battery and throwing a deadly missile. The conviction stemmed from a shooting outside Bottomz Up nightclub on Blanding Boulevard in December 2012.
“I was more fearful today than I've ever been,” Denisha Moxon said following the hearing Friday. It was the first time Moxon had seen her accused shooter since his trial.
Moxon is a mother of four children, and says she has suffered daily since being shot in the face by Wilcoxen, which left her legally blind.
“I want to tell my story, and I just want justice,” said Moxon.
Wilcoxen was never sentenced following his conviction in July. A judge overturned the decision after a public defender argued various problems with closing arguments during the trial. The state has now appealed that motion.
In the meantime, Wilcoxen was ordered detained until the details of a possible retrial are confirmed. On Friday, Assistant Public Defender Sandra Young requested he be released from jail on his own recognizance until then.
Moxon says that has been and is her greatest fear. She was prepared to testify again Friday if needed. She accuses Wilcoxen of trying to reach her since his conviction from behind bars.
“I kept thinking the judge was going to let him out. I was petrified for my own safety and the safety of my children.”
After hearing an hour of arguments, the judge determined Wilcoxen is a flight risk and poses a danger to the community. He then granted a total of $300,000 bond, the same amount posted by Wilcoxen in the months prior to his first trial.
Moxon hopes that amount will keep her accused shooter behind bars this time.
“I'm overwhelmed with joy that he's not going to be out of jail anytime soon to cause harm to me, my family or even my children.”
Young declined to comment on the case Friday.
Wilcoxen is scheduled to return to court on Oct. 2 for a status hearing.
