Patrick McDowell: State seeking the death penalty for man accused of killing Deputy Joshua Moyers

NASSAU COUNTY, Fla. — The state said on Friday it will seek the death penalty against the man accused of killing Nassau County Sheriff’s Office Deputy Joshua Moyers.

A Nassau County grand jury returned an indictment for Patrick McDowell, 35, on charges of first-degree murder, injuring or killing a police dog and eight counts of aggravated assault on a law enforcement officer, according to a news release from State Attorney Melissa Nelson’s office.

McDowell is accused of shooting Moyers during a traffic stop on Friday, Sept. 24 in Callahan. On Sunday, Sept. 26, Moyers died as a result of his injuries. His organs were donated to save the lives of five people, including a baby.

McDowell is also accused of shooting and injuring Jacksonville Sheriff’s Office K9 Chaos, who is continuing to recover. McDowell was captured on Tuesday, Sept. 28, at a baseball field in Callahan following a five-day manhunt.

McDowell will be arraigned on the charges on Thursday, Oct. 21, according to the release.

Breiana Tole, 27, of Jacksonville, is accused of helping McDowell evade capture and has been charged with accessory after the fact, which is a felony. According to court documents, she has entered a plea of not guilty.
