No decision made on charges in Whataburger shooting

FLEMING ISLAND, Fla. — The State Attorney's Office has not made a decision yet about whether to charge a man who shot another man who allegedly approached his vehicle while he was in line at a Whataburger drive-through in Fleming Island on New Year's Day.

Matthew Aston, 28, was in line in his vehicle at the drive-through around 2 a.m. when Daniel Grady, 22, came up to his vehicle, according to Clay County Sheriff's Office spokeswoman Mary Justino. An argument between the two took place and Aston fired a gun at Grady, who died at the scene.

Aston drove home and called CCSO to report the incident, Justino said.

The State Attorney's Office is expected to review all the evidence in the case thus far and make a decision on how to proceed.

No photos of Aston were available from CCSO, as he has had no prior adult arrests in Clay County.
