JACKSONVILLE, Fla. — The trial for the man accused in death of 8-year-old Cherish Perrywinkle has been delayed.
Donald Smith is accused of kidnapping, raping and killing Cherish in 2013.
The Jan. 17 trial date was struck by the judge on Tuesday due to issues with the recent death penalty cases.
The next pretrial hearing is scheduled for Dec. 12.
Smith is charged with first-degree murder, kidnapping a child and sexual battery on a child.
