JACKSONVILLE, Fla. -- All charges against the brother of Jacksonville Sheriff John Rutherford have been dropped.
Police arrested Hubert Rutherford last month when a birthday celebration reportedly turned violent.
Hubert Rutherford faced charges related to domestic violence.
The State Attorney's Office released this statement about the case:
The case cannot be filed based on a number of factors: injuries to both defendants - who have a self-defense claim, lack of cooperation by the victim's mother (victim is 15 years old), the victim's minor injuries and her admission she beat defendant Reynolds so badly she called 911 to get Reynolds help. Also, there are no independent witnesses to the incident. Due to the reasons above, there is no reasonable probability of conviction.
