Michael Dunn appeals murder conviction

TALLAHASSEE, Fla. — A man convicted of killing a 17-year-old in an argument over loud music at a Southside gas station is appealing his murder conviction.

Michael Dunn shot and killed Jordan Davis in 2012.

Dunn’s lawyers appeared Tuesday morning in an appeals court in Tallahassee.

Special Assistant Public Defender Terry Roberts, who is representing Dunn, said the evidence in both trials was insufficient to rebut claims of self-defense, and he wants the first-degree murder conviction overturned.

Roberts told a panel of judges that two of the teenagers in the car with Davis, Leland Brunson and Tevin Thompson, agreed during testimony that Dunn didn't initially speak to Davis. He said their testimony shows that the framing of the conversation was not accurately presented.

“He was polite and asked that the music be turned down,” said Roberts. “He asked that of Mr. Thompson, not Mr. Davis, and Mr. Thompson did that. Mr. Thompson verified that this was a request and wasn't an order. There was nothing angry or confrontational about this and he turned it down.”

The panel did not indicate how it would rule. Appeals courts can often take weeks or months to decide cases.
